These terms of use apply to the mobile games published by alphaC (alphaC UG (haftungsbeschränkt), Saarbrücken, Germany) on Google Play and the Apple App Store.
Last updated: 8 October 2026
1. Provider and scope
The games are provided by alphaC UG (haftungsbeschränkt), Am Hagen 2, 66117 Saarbrücken, Germany, represented by Marina Dryzlova, commercial register: Amtsgericht Saarbrücken, HRB 106968, email: admin@alphac.tech ("we", "us").
These terms govern the use of our games (the "Games"). The download itself is subject to the terms of the respective app store (Google Play or the Apple App Store). If a Game is distributed through the Apple App Store, Apple's Licensed Application End User License Agreement (Standard EULA) applies in addition; Apple is not responsible for the Games or their content.
2. Use of the Games
The Games can be downloaded and played free of charge. Some Games offer optional in-app purchases (section 5). We grant you a simple, non-transferable, non-exclusive right to use the Games on your own devices for private, non-commercial purposes.
The Games are intended for users aged 13 and over. Minors may only use the Games with the consent of their parents or guardians.
3. Advertising
The Games are financed by advertising. Ads are shown during the game (for example, between levels). Some Games offer optional ads ("rewarded videos") that you can watch voluntarily to receive an in-game reward. The reward is granted once the video has been watched to the end. There is no entitlement to an ad being available at any particular time. In Games that offer the "Remove Ads" purchase, ads that are shown automatically (for example, between levels) are no longer displayed after the purchase; optional rewarded videos may remain available. Information on the data processed for advertising can be found in our privacy policy for mobile games.
4. Virtual items and in-game currency
In the Games you can earn virtual items and in-game currency (for example, coins or cosmetic items). These have no monetary value, cannot be exchanged for real money or other goods and cannot be transferred to other users or devices.
Game progress, virtual items and in-game currency are stored only on your device. They are lost if you delete the app's data, uninstall the app or change your device. We cannot restore them, as we do not store them on our servers.
5. Purchases
Some Games offer optional in-app purchases with real money, for example "Remove Ads". The price is shown in the app store before the purchase. The purchase is made through the respective app store (Google Play or the Apple App Store); payment and refunds are governed by its terms.
Purchased items are permanent unless stated otherwise in the Game. They are linked to the app store account used for the purchase and can be restored after reinstalling the Game or on another device with the same account. Purchased items apply only to the Game in which they were bought and cannot be transferred to other users.
Your statutory rights, in particular under the provisions on digital products (Sections 327 et seq. BGB), remain unaffected.
6. Leaderboards
Some Games offer leaderboards via Google Play Games. Participation is voluntary and requires signing in with Google Play Games. Your player name and avatar from Play Games and your score will then be visible to other players. We may remove scores that were obviously achieved through manipulation or by exploiting errors.
7. Rules of conduct
You must not:
- manipulate the Games, use cheats, bots or other unauthorized software, or deliberately exploit errors to gain an advantage;
- modify, decompile or reverse-engineer the Games, unless this is permitted by mandatory law (in particular Section 69e of the German Copyright Act);
- use the Games or their content for commercial purposes or make them available to third parties;
- interfere with the operation of the Games or the services connected to them.
8. Intellectual property
All rights to the Games and their content (in particular graphics, sounds, music, texts, characters and software) belong to us or our licensors. These terms do not grant you any rights beyond those described in section 2.
9. Availability and updates
We provide updates, in particular security updates, to the extent required by law. Beyond that, we may further develop and change the Games (for example, add or change levels, features or the design) if there is a valid reason, such as technical development, changed legal requirements or improvement of the game. Changes are free of charge for you. If a change significantly impairs your use of a Game, we will inform you in advance; in this case your statutory rights, in particular the right to terminate under Section 327r of the German Civil Code (BGB), remain unaffected.
Functions that depend on third-party services (such as leaderboards or ads) may be temporarily unavailable.
10. Warranty
The statutory provisions apply, in particular the provisions on digital products (Sections 327 et seq. BGB).
11. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and to the extent we have given a guarantee.
In the case of slight negligence, we are only liable for breaches of essential contractual obligations, that is, obligations whose fulfilment makes the proper use of the Games possible in the first place and on whose compliance you may regularly rely. In this case, our liability is limited to the typical damage foreseeable at the time the contract was concluded. Otherwise, liability for slight negligence is excluded.
These limitations also apply in favour of our employees and agents.
12. Termination
You can stop using the Games at any time by uninstalling them. We may terminate the right of use for good cause, in particular in the case of serious or repeated breaches of section 7.
13. Changes to these terms
We may change these terms for a valid reason, for example due to changes in the law or new features of the Games. We will inform you of changes in good time, for example in the Game or in the store description. The changed terms apply to versions of the Games that you install or update after being informed.
14. Privacy
Information on how we process personal data can be found in our privacy policy for mobile games.
15. Consumer dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
16. Right of withdrawal
If you are a consumer, you have a statutory right to withdraw from a contract with us within 14 days without giving any reason. The withdrawal period begins on the day the contract is concluded, that is, when you download the Game or make an in-app purchase. To exercise the right of withdrawal, you must inform us (alphaC UG (haftungsbeschränkt), Am Hagen 2, 66117 Saarbrücken, Germany, email: admin@alphac.tech) of your decision by means of a clear statement (for example, by email).
Since you do not pay a price for downloading and playing the Games, the right of withdrawal for this contract expires as soon as we have begun to perform it, that is, as soon as the Game is made available to you for download (Section 356(5) No. 1 BGB).
For in-app purchases, the right of withdrawal expires once the purchased item has been provided to you if you have expressly agreed in the purchase process that performance begins before the end of the withdrawal period and have acknowledged that you thereby lose your right of withdrawal (Section 356(5) No. 2 BGB). Withdrawals and refunds for in-app purchases can also be requested directly from the app store in accordance with its terms.
Regardless of this, you can stop using a Game at any time by uninstalling it (section 12).
17. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country in which you have your habitual residence.
If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Saarbrücken.
Should individual provisions of these terms be invalid, the statutory provisions apply in their place.
These terms are available in German and English. In the event of discrepancies, the German version prevails.
